Terms of Service – DustBowl.Games

1. Acceptance of Terms

By accessing or using the DustBowl.Games website and services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services.

2. Description of Services

DustBowl.Games provides game server hosting, web services, and community tools including but not limited to:

Public shared game servers (DustBowl hosted)
Private game server hosting on shared hardware
Dedicated game server hosting on dedicated hardware
Web services (TeamSpeak, Discord bots, VTT hosting)
Community tools and player profile management

3. Accounts

Account creation requires authentication through a supported OAuth provider (Steam, Discord, or Microsoft). You are responsible for all activity that occurs under your account. You agree to:

Provide accurate information when linking accounts
Maintain the security of your OAuth provider accounts
Notify us immediately of any unauthorized use
Not share, sell, or transfer your account access

4. Eligibility & Age

You must be at least 18 years old to create an account, make a purchase, or use the Services. We do not offer a date-of-birth or identity-verification flow as part of this policy. By using the Services, you represent that you meet this requirement.

Our Services are not directed to children. If you are a parent or guardian and believe a child has used our Services, contact us at [email protected] and we will review and take appropriate steps.

5. Acceptable Use

You agree not to:

Use our Services for any illegal purpose
Harass, abuse, or threaten other users
Exploit, cheat, hack, or use unauthorized modifications on our servers
Attempt to gain unauthorized access to our systems
Conduct DDoS attacks or interfere with service availability
Use our Services to distribute malware or harmful content
Resell or redistribute our Services without authorization
Engage in team killing, griefing, or other disruptive behavior on servers with active TK protection

6. Payment & Billing

Prices are listed in USD and are subject to change with 30 days notice
Subscriptions auto-renew unless cancelled before the renewal date
Dedicated server orders require a 7-12 day lead time for hardware provisioning
All payments are processed through our authorized payment processors
You are responsible for any applicable taxes

8. Service Availability

We commit to 98% monthly uptime per game server, backed by 24/7 monitoring. This is a deliberate, honest target based on our residential infrastructure — not an aspirational number we can't back up. Full details including measurement, exclusions, and credit schedule are in our Service Level Agreement.

We reserve the right to:

Perform scheduled maintenance with at least 24 hours notice
Modify, suspend, or discontinue any Service feature
Limit or restrict access during high-traffic events

We are not liable for downtime caused by factors outside our control including upstream ISP outages, Cloudflare/DNS issues, game developer outages, DDoS attacks, or force majeure events.

9. Intellectual Property

The DustBowl.Games name, logo, website design, and original content are our property. Game names, logos, and trademarks belong to their respective owners. You may not use our branding without written permission.

10. Disclaimer of Warranties

The Services are provided on an "AS IS" and "AS AVAILABLE" basis, with all faults and without warranty of any kind. To the maximum extent permitted by law, DustBowl.Games disclaims all warranties, whether express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Services will be uninterrupted, error-free, secure, or free of harmful components, or that any data, game progress, or content will not be lost or corrupted. Any uptime commitment we make is governed by our Service Level Agreement and does not expand the warranties in these Terms.

11. Limitation of Liability

To the maximum extent permitted by law, DustBowl.Games shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or game progress, arising from your use of our Services.

Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless DustBowl.Games and its owners, operators, and staff from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Services; (b) any content you submit, host, or transmit through the Services; or (c) your violation of these Terms or of any applicable law or the rights of a third party.

13. Termination

We may terminate or suspend your access to our Services at any time, with or without cause, with or without notice. Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination shall survive.

14. Governing Law

These Terms are governed by the laws of the State of North Carolina, United States. Any disputes shall be resolved in the courts of Caldwell County, North Carolina.

15. Changes to Terms

We may update these Terms at any time. Material changes will be communicated through our website or Discord server. Continued use of Services after changes constitutes acceptance.
